Summary of Case: |
"Mark James Phillips was wrongly convicted in September 2006 of assault for a March 2006 incident when a woman awoke to find him in her bed in Middlesbrough, England. Phillips claimed he had suffered from sleepwalking for years, but the jury found him guilty. He was sentenced to 3-1/2 years in prison. Phillips conviction quashed in November 2008 as unsafe because new scientific evidence shows the sleep walking syndrome he suffered from for years could have resulted in him unknowingly finding himself in a woman's bed." |
Conviction Caused By: |
Erroneous expert testimony that Phillips could not have been sleepwalking when he wound up in a woman's bed. |
