"In January 2007 the California Court of Appeals reversed Pineda's conviction and ordered a retrial on the basis the judge had prejudicially erred by failing to to instruct the jury on involuntary manslaughter so it didn't know it could have returned that as a verdict. After a retrial, on October 21, 2008 Pineda was acquitted by a jury of murder, but the jury didn't reach a verdict on on the reduced charge of involuntary manslaughter. The judge declared a mistrial on the lesser charge of manslaughter. Pineda was released on bond on November 25, 2008. On April 16, 2009 the prosecution's motion to dismiss the manslaughter charge was granted."
