Summary of Case: |
"Larry Pohlschneider was wrongly convicted in 2000 of child molestation in Red Bluff, California. Pohlschneider was sentenced to 24 years in prison. His lawyer didn't challenge the expert evidence that linked him to the crimes. At the time of Pohlschneider's conviction Albert Harris, had been charged, confessed to committing, and ultimately pled guilty to the crime. A post-conviction investigation of Pohlschneider's case found evidence that the expert evidence relied on to convict him was unreliable, and supported that Harris was the sole perpetrator. On October 7, 2015 the charge was dismissed and Pohlschneider ordered released when the Tehama County Superior Court granted a motion to vacate his conviction that was unopposed by the Tehama County District Attorney's Office. The motion was based on Pohlschneider receiving ineffective assistance of counsel during his trial. Pohlschneider's trial lawyer, California State Bar records show that Thomas James Hilligan was 72 when he resigned his license to practice law on June 29, 2008 while professional misconduct charges were pending against him in an unrelated case. On April 25, 2016 the State of California Victim Compensation and Government Claims Board awarded Larry Pohlschneider compensation of $762,440: $140 for each of his 5,446 days in custody from his arrest on November 16, 2000 to his release from prison on October 14, 2015." |
