Summary of Case:

"Tabitha Pollock was wrongly convicted of the October 10, 1995 murder of her 3 year old daughter, Jami Sue was murdered by her live-in boyfriend, but her conviction was based on the prosecution's theory that she should have known that he was capable of killing her daughter. The Illinois Sup Ct reversed her conviction in Oct 2002 on the basis that a person cannot be convicted of murder on the basis that what they should have known what someone else would do - but only on the basis of what they actually knew. [This was similar to the reasoning the Nevada Supreme Court used in 2000 to overturn the murder conviction of Kriseya J. Labastida in the murder of her infant daughter by her husband.] She was released just before Christmas 2002.
