"Benjamin Puente was wrongly convicted in 2009 of statutory rape for allegedly arranging a liason with a 16-year-old girl for the purpose of having sex with her. Puente was convicted after his third trial He was sentenced to 1 year in prison and registration as a sex offender. On December 20, 2010 California's 6th District Court of Appeal acquitted Puente on the basis there was insufficient evidence he committed a crime. The court also said a Santa Clara County prosecutor was "vindictive" in pursuing a felony conviction against Benjamin Puente. The court found that prosecutors pursued the charge after previously agreeing that it was flawed and should be dismissed." |
