Summary of Case:

"Philip Queree aka Philip Norman Richard Queree, was wrongly convicted in August 2017 of indecent assault of a woman on August 20, 2016 in Jersey. Jersey is a small country of about 100,000 people that is located on the the largest the Channel Island between England and France. Queree's prosecution was based on the complaint of a woman who claimed that during consensual sex he grabbed her breasts too hard. Queree and the woman had met using the Tinder online dating app. Their first date was on August 18, 2016, and it was on their second date that the sexual encounter occurred that resulted in Queree's prosecution. The woman was identified in court as Miss X under Jersey's non-disclosure of sex victims. The woman testified that she told Queree not to touch her breasts at all when they had sex. She didn't testify that she asked Queree to stop. The prosecutor argued that Queree's assault was indecent because during sex she withdrew consent for him to touch her breasts which are "sexual," and he continued touching them. Queree testified that the woman asked him to be more gentle in touching her breasts during their "vigorous sex making," but she didn't ask him to stop. After Magistrate Bridget Shaw found Queree guilty, she ordered him to serve 180 hours of community service; pay £2,000 (US$2,630) towards his prosecution costs; register as a sex offender for five years because he posed “a risk of sexual harm to others”; and, he was barred by a restraining order from contacting Miss X for five years. Queree was a medical student, and his conviction and sentence prevented him from proceeding with his medical career. Queree appealed. After hearing oral arguments on Janury 4, 2018, the Royal Court of Jersey issued an oral order setting-aside Queree's conviction on the basis the prosecution introduced insufficient evidence to prove he indecently assaulted Miss X. The Court stated the assessment of the evidence by the "Magistrate went wrong in a material way." The Court stated it will publish its written ruling at a later date."
