Summary of Case:

"Jai Narayan Rai was wrongly convicted of a murder committed on October 21, 1889 in the village of Patuha, India. Rai's conviction was based solely on his purported confession on November 11, 1889 to a Deputy Magistrate that was recorded in English, although Rai only spoke and understood Hindi. Rai denied committing the murder of the man who had been released on bail after being charged with murdering Rai's father Soorji, by striking him on his head during a riot in Pathua in September 1889. During Rai's trial the judge specially rejected all evidence of his guilt, except for his purported confession. On April 22, 1890 the Indian High Court in Calcutta quashed Rai's conviction and ordered his acquittal on the basis of "non-compliance" with the statute because his alleged confession wasn't recorded in his native Hindi, but in English that he didn't understand. The Court stated: "... apart from the confession, there is no proof against the prisoner, we must set aside the conviction and dirct that the prisoner be acquitted.""
