Summary of Case:

"S. Arul Raja wa wrongly convicted by the Madras High Court in August 2009 of the December 31, 2004 murder of Alladi Aruna in Tirunelveli, India. Raja's conviction was based on the prosecution's reliance on the alleged "dying declaration" of a witness who not only didn't die, but who wasn't even admitted to a hospital. Based on that evidence the sessions court in Tirunelveli acquitted Raja in April 2008, but the High Court reversed the trial court's ruling. Raja appealed. In July 2010 the Supreme Cout of India quashed the murder conviction of S Arul Raja and acquitted him on the basis the prosecution failed to introduce insufficient admissible evidence. The Supreme Court ruled that a "dying declaration" is inadmissible if a person doesn't die, and without that evidence there was no credible evidence Raja committed the crime.."
