Summary of Case:

"Anantha Ramulu was wrongly convicted on September 2, 1996 of public corruption for being a government official possessing a disproportionate amount of personal assets compared to his income. At the time Ramulu was charged he was working as a Junior Co-operative Inspector/Auditor in the State Cooperative Department at Khammam district. During his trial the prosecution argued he had assets of Rs. 263,000 that were disproportionate to his income. After his conviction Ramulu was sentenced to three years rigorous imprisonment and fined Rs. 20,000. The judge also ordered forfeiture of two houses Ramulu's wife owned, with the proceeds from their sale to go into the public treasury. Ramulu appealed, staying both his prison sentence and the confiscation order. On October 2, 2004 the Andhra Pradesh High Court upheld Ramulu's conviction, but reduced his prison sentence to one year and also set aside the confisication order. Ramulu appealed that ruling. On October 27, 2010 India's Supreme Court in New Delhi quashed Ramulu's conviction on the basis the prosecution hadn't proved his personal assets were disproportionate under the law. The Court's ruling stated: "You (Government) do not take action against the big sharks and crocodiles. They are allowed to go scot free. If possessing Rs 2.60 lakh is considered to be disproportionate to the known sources of income, then we may have to send every Government official to the jail.""
