Summary of Case:	"Mark Allen Reed was wrongly convicted of improper photography for publicly taking a photograph of a woman without her consent while she was browsing for a movie to rent in the Hastings records and music store in Longview, Texas. Reed was indicted on September 17, 2009. After his conviction Reed was sentenced to 2 years in prison. In 2011 Reed's conviction was affirmed on appeal. In 2014 the Texas Court of Criminal Appeals ruled that the statute under which Reed was convicted was unconstitutional. See, Ex parte Thompson, 442 S.W.3d 325 (Tex. Crim. App. 2014) Reed filed a state habeas corpus petition to vacate his conviction based on the 2014 ruling in the Thompson case. On January 13, 2016 the Texas Court of Criminal Appeals granted Mark Allen Reed's habeas corpus petition by a majority of 2 to 1, on the basis the statute he had been convicted of was unconstitutional as the court had determined after his conviction was affirmed in 2011. The Court ordered that Reed's conviction be set-aside and ordering dismissal of charges."
