Summary of Case:

"Richard Carrillo was wrongly convicted in July 2015 of driving while intoxicated and illegal possession of a firearm while intoxicated, on February 27, 2015 in Carson City, Nevada. Carrillo, 48, was a three-term Assemblyman from Las Vegas in the Nevada Legislature. Carrillo's was arrested by a police officer who saw him sleeping in his car on the morning of Feb. 27..During his trial the prosecution introduced evidence that Carillo's blood alcohol content was 0.10, and the legal limit in Nevada is 0.08. After his conviction following a bench trial in Justice Court, Carrillo was sentenced to pay a fine of $800, serve 42 hours of community service, and not possess a firearm for one year. Carrillo appealed his conviction, arguing that the blood test was inadmissible under his constitutional right to confront his accuser, because the prosecution presented hearsay evidence about the blood test since the person who testified about the results of the test did not conduct the testing, but relied on information provided by others. On January 26, 2016 Washoe County District Court Judge James Wilson acquitted Carrillo of both counts, ruling that the blood test results was inadmissible, and without that evidence their was insufficient evidence to support his conviction."
