Summary of Case:

"James A. Rigsbee was wrongly convicted of murdering one man and assaulting another with a deadly weapon. After Rigsbee's conviction by a jury he was sentenced to prison. On appeal, the government confessed error because the jury's verdict had not been unanimous. The Court of Appeals for the District of Columia reversed Rigsbee's conviction and remanded for a new trial. At the second trial, the jury found Rigsbee not guilty under both counts of the indictment, and he was freed from custody. Rigsbee filed a petition with the U.S. Court of Claims for compensation under 28 U.S.C. § 1495. In spite of the jury's acquittal, the judge denied granting a Certificate of Innocence necessary for Rigsbee to pursue his compensation claim. Rigsbee appealed, and on April 30, 1953 the Court of Appeals affirmed the lower court's ruling."
