Summary of Case: |
"Tony Lane Roach was wrongly convicted of criminal trespass in Forsyth County, Georgia. Roach appealed. Roach was convicted of trespassing at the Cumming Group, a substance abuse facility in Cumming. Roach appealed. On December 14, 2007 Roach's conviction was reversed by the Georgia Court of Appeals based on insufficient evidence proving his guilt beyond a reasonable doubt. The Court ruled that although Roach was convicted based on the accusation he committed criminal trespass by "remaining upon the premises of THE CUMMING GROUP. ... The evidence in this case showed to the contrary. Roach left the premises immediately after receiving notice to depart. ... Since the state's evidence failed to establish a violation of the crime charged in the accusation, the conviction must be reversed." Roach v. State, 656 SE 2d 165, 289 Ga. App. 23 (Ga. Ct of Appeals 2007)" |
