Summary of Case: |
"Stacey Robinson was wrongly convicted on May 13, 2015 of intent to cause grievous bodily harm and using a firearm to commit an indictable offence related to an incident on April 30, 2014 on St. David's island in Bermuda during which a person was shot twice in his leg. After a jury trial in the Supreme Court, two of Robinson's codefendants were acquitted, and Robinson was convicted by a 9 to 3 majority. Robinson was sentenced to 12 years in prison, and he appealed. On November 19, 2015 the Court of Appeal for Bermuda set-aside Robinson's convictions on the basis the judge prejudicially erred by allowing the jury to hear hearsay testimony by a witness that a codefendant, Shannon Dill, who pled guilty, said that Robinson was “in trouble.” The Court said the prejudicial value of the hearsay testimony outweighed its prbative value." |
