"John Michael Rosa was wrongly convicted of possession of a controlled substance and sentenced to three years imprisonment. Rosa pled guilty to lesser charges to minimize his sentence from a conviction after a trial. Post conviction testing of the substance in Rosa's possession showed that the amount of narcotics seized was less than alleged in the indictment and did not meet the legal standard for a crime. Rosa filed a writ of habeas corpus to withdraw his plea as unknowing and involuntary based on the new evidence. The trial court concluded that Rosa's plea was unknowing and involuntary. On June 29, 2016 the Texas Court of Criminal Appeals granted Rosa's habeas petition." |
