Summary of Case: |
"Frederic Saecker was wrongly convicted on January 5, 1990 of sexual assault, burglary and kidnapping. Saecker's conviction was based on his identification by the victim. He was sentenced to 15 years in prison. In 1994 DNA testing conducted on evidence that became available excluded Saecker as the assailant. He was granted a new trial on September 27, 1994. The prosecution appealed and on August 8, 1995 the WI Court of Appeals affirmed the granting of a new trial. He was released in May 1996 when the prosecution agreed to dismiss the charges and not retry him. Saecker was in custody for 6 years and 11 months from the time of his arrest in June 1989 to May 1996. Saecker was awarded compensation of $25,000 plus $20,000 for legal fees, by the Wisconsin State Claims Board on December 19, 2002." |
