Summary of Case:

"Deon Sams was wrongly convicted in November 2014 of official misconduct related to a sexual encounter he had with a woman on March 24, 2012 at a hotel in Villa Park, Illinois. Sams was a police officer in Maywood, Illinois, and earlier that night the woman had been arrested and charged with drunk driving. After she was released Sams and the woman went to a hotel and engaged in sexual relations. The woman accused Sams of sexual assault, but he was acquitted in November 2014 after a bench trial. However, he was found guilty of official misconduct. Prior to his sentencing Sams filed a post-verdict motion for a new trial that his conduct didn't meet the standard for offiical misconduct. Sams' lawyer argued that he had, at worst, only violated Maywood Police Department regulations, and had not broken any state law that would trigger an official misconduct charge. On Febuary 17, 2015 DuPage County Judge George Bakalis granted Sims' post-verdict motion and acquitted him of official misconduct."
