Summary of Case:

"Daniel Lawrence Sanders was wrongly convicted and sentenced to prison on October 23, 1997 of child molestation in Clark County, Washington. Daniel Sanders maintained his innocence throughout his trial. After his conviction by a jury, Sanders was sentenced to nine years in prison based on an alleged agreement with the prosecution to waive his right to appeal in exchange for the reduced sentence. Sanders' convictions were affirmed on direct appeal. He filed a post-conviction petition that alleged ineffective assistance of counsel and prosecutor misconduct -- alleging he had not made a knowing waiver of his right to appeal. His petition was denied by the Washington state courts, and by the U.S. District Court after he filed a federal habeas petition. Sanders appealed. The U.S. Ninth Circuit Court of Appeals granted his habeas corpus petition on June 6, 2006 in ruling his trial attorney provided constitutionally ineffective assistance of counsel, based on his attorney's failure to investigate and interview potentially exculpatory witnesses. Sander's claimed from the time he was arrested that he was innocent and the prosecutor, who Sander's had worked for as a snitch, was retaliating against him for failing to provide information satisfactory to the prosecutor. Sanders had been released on parole in June 2005 after 8 years of imprisonment while his federal habeas was pending. On August 28, 2006 U.S. District Court Judge Robrt J. Bryan of the Western District of Washington ordered Daniel Sanders released from the custody of the Washington Dept. of Corrections that was supervising his parole, and termination of his requirement to register as a sex offender. (As of April 28, 2014 Daniel L. Sanders was not in the custody of the Wash DOC or in the Washington or nation sex offenders registry.)"
