Summary of Case:

"Musa Sani was wrongly convicted of an armed robbery that allegedly occurred in May or June 2008 in Katsina, Nigeria. Sani and a codefendant, Ifanye Amah, allegedly at gunpoint robbed a man of N940,000 (Approx. US$4,725) and other items that included one computer set, two cameras and three mobile phones. Sani presented an alibi defense establishing he was at the Lunar Hotel, in Katsina att the time of the alleged robbery the "victim" told police occurred elsewhere. Sani his codefendant were convicted based on the testimony of the alleged victim, and they were both sentenced to death. Sani appealed, but his codefendant did not. After Nigeria's Court of Appeal affirmed Sani's conviction he appealed to the Supreme Court. On June 26, 2015 Nigeria's Supreme Court set-aside Sani's conviction and ordered his acquittal on the basis the prosecution introduced insufficient evidence to prove beyond a reasonable dout he was involved in the robbery. The Court also noted the irregularity of the alleged victim's testimony by failing to establish that he was actually robbed of N940,000, the source of the money, and he told police he was robbed on May 28, 2008, a Saturday, but it was proved that the robbery could only have taken place Wednesday, May 25, 2008. The Court said that the deficient police investigation failed to establish if a robbery had even occurred. Sani was ordered discharged immediately. The Court made no ruling on Amah's conviction because he had not yet appealed the judgment against him."
