Summary of Case:

"Karl A. Schledwitz was wrongly convicted in 1992 of mail fraud in Memphis, Tennessee. Schledwitz was an attorney and he was prosecuted based on the allegation that beginning in 1980 he was involved in a fraudulent bank loan scheme devised by brothers Jake and C.H. Butcher, who both pled guilty to various charges and were sentenced to prison. Schledwitz was sentenced to 6 months in prison, but his sentence was stayed pending the outcome of his appeal. Schledwitz filed a post-conviction petition claiming that the prosecution violated his right to due process by failing to disclose favorable FBI reports of its interview of Jake Butcher and three other people witnesses as required under Brady v. Maryland (1963). The District Court denied Schledwitz' petition, and he appealed. On March 3, 1999 the U.S. 6th Circuit Court of Appeals vacated Schledwitz' convictions on the basis the cumulative effect of prosecution's failure to disclose the favorable evidence likely affected the jury's verdict. Karl Schledwitz wasn't retried."
