Summary of Case:

"Winston Lamont Scott was wrongly convicted in 1976 of Rape, Sodomy and Burglary committed against a 19-year-old woman in Fairfax County, Virginia on July 24, 1975. Scott's prosecution was based on his identification by the victim in a photo spread, and again in court. After his conviction Winston Scott was sentenced to 14 years. Scott was paroled in 1981 after more than five years in custody. Scott filed a petition to vacate his conviction based on post-conviction DNA testing that in 2017 excluded him as the woman's assailant. Winston Scott's conviction was vacated on March 7, 2019 by the Virginia Supreme Court. The Court unanimously ruled that in consideration of the new DNA evidence, “no rational trier of fact would have found him guilty beyond a reasonable doubt.” Scott was one of 13 men cleared of a felony crime since 2005 when Virginia passed a post-conviction DNA testing law. A bill was submitted in the Virginia legislature to award Scott compensation of $160,000 for his wrongly imprisonment."
