"On April 5, 2017 the Illinois Appellate Court, 4th Dist. reversed Shakirov's conviction based on insufficient prosecution trial evidence to prove his guilt beyond a reasonable doubt. The prosecution failed to introduce sufficient evidence to prove the essential element that Shakirov acted recklessly. The Court's ruling stated: "The best that can be said of the State's case is that defendant may have been inattentive for a few seconds (perhaps adjusting his radio or engaging in some similar activity) and then failed to realize the left lane was blocked as he unsuccessfully attempted to brake his huge semi at night on an icy highway in blowing snow. Such brief inattention (if it even occurred) falls far short of the conscious disregard of a substantial and unjustifiable risk that establishes a gross deviation from the standard of care that the State needed to prove beyond a reasonable doubt. This evidence does not come close to meeting that standard." [People v. Shakirov, 74 NE 3d 1157 (Ill. Appellate Court, 4th Dist. 2017)]"
