"On September 17, 2017 the Illinois Appellate Court, 1st Dist. reversed Shaw's conviction based on insufficient prosecution trial evidence to prove his guilt beyond a reasonable doubt. The Court's ruling stated: "¶ 32 Therefore, even when taking all the evidence in the light most favorable to the State, we find that a rational trier of fact could not have found Shaw guilty of robbery beyond a reasonable doubt. Accordingly, the judgment of the circuit court of Cook County is reversed. [] ¶ 33 The constitutional prohibition against double jeopardy (U.S. Const., amends. V, XIV; Ill. Const. 1970, art. I, § 10) applies to preclude the State from retrying the defendant after a reviewing court reverses a conviction based on evidentiary insufficiency. Therefore, "the only proper remedy is a judgment of acquittal." [People v. Shaw, 41 NE 3d 552 (Ill. Appellate Court, 1st Dist., 2nd Div. 2015)]"
