Summary of Case:

"Michael Shaw was a customs officer wrongly convicted in June 2015 of violating Jamaica's Corruption Prevention Act. Shaw's prosecution was based on the allegation that in 2015 he accepted a bribe of $2,000 to allow a man to bring $16,000 cash into Jamaica without declaring he had the money -- which was in excess of the limit of $10,000 cash that could be brought into the country without it being declared to Jamaican Customs. The man reported upon entering Jamiaca that he had no cash. The man was the prosecution's key witness during Shaw's trial. Shaw's defense was he received no money from the man who was known to tell tall tales and his lawyer argued the man's testimony was inconsistent. After his conviction Shaw appealed. In February 2018 a three-judge panel of the Jamaica's Court of Appeal unanimously set-aside Shaw's convictions based on the uncorroborated inconsistent testimony of the prosecution's key witness, and that the trial judge erred by unreasonably rejecting Shaw's testimony. The panel of Justice Dennis Morrison, Justice Sinclair Haynes and Justice McDonald Bishop, allowed Shaw's appeal, set aside his conviction, and entered a verdict of acquittal."
