Summary of Case: |
"Ankush Maruti Shinde, Rajya Appa Shinde, Ambadas Laxman Shinde, Raju Mhasu Shinde, Bapu Appa Shinde and Surya alias Suresh Shinde were codefendants wrongly convicted in 2004 of murder and rape in Nashik, India. Their prosecution was based on a gang of seven to eight people attacking a family of seven about 10:30 pm on June 5, 2003, with the family robed, a woman raped, and five persons killed that inclded a juvenile. After their conviction in Nashik all six were sentenced to death. In 2007 the Bombay High Court modified the convictions of three defendants and reduced their sentence to life imprisonment. The State and the defendants both appealed, and in 2009 India's Supreme Court reinstated the convictions and death sentence of the three and affirmed the convictions and death sentence of the other three. The Supreme Court agreed to reconsider its 2009 ruling. On March 5, 2019 India's Supreme Court reversed its 2009 ruling, and set aside the convictions of all six defendants. The Court ruled that they had been "falsely implicated" in the crime and there was no credible evidence they were involved in the crime. The Court stated they were convicted because there was “no fair investigation and fair trial in the case." The Court also ordered compensation of Rs 5 lakh (US$7,095) for each defendant. The Court further ordered a reinvestigation of the crime to identify the actual rapist-murders." |
