Summary of Case:	"Jeffrey Shoemaker was wrongly convicted after an April 2007 bench trial of creating child pornography for several photographs he took of nude boys at a party hosted by his son. On May 23, 2008 the Illinois 4th District Court overturned Jeffrey Shoemaker's conviction and ordered his release, after determining about the photos taken by Shoemaker, that "None met the legal description for what ‘lewd' means under Illinois law." The prosecution appealed, but the State Supreme Court declined to hear the case and he was released in August 2008. In November 2008 a judge ordered the State of Illinois to expunge Shoemaker's criminal record of any traces of his conviction. Shoemaker sought the expungment after a traffic stop during which the police that checked on his record and found his "sex conviction," questioned him about the validity of his driving privileges and inquired about his registration as a sex offender. The matter was cleared up after three hours, but the only way to prevent a reoccurence was to wipe any trace of his arrest and conviction from State's files. The Court's ruling also allowed Shoemaker to receive a refund of more than $2,000 in court fees and property taken by police."
