Summary of Case:

"Olga V. Shved was acquitted on February 21, 2014 after a bench trial in Franklin County Superior Court in Pasco, Washington. It was her second trial for the allegedly assaulting her 4 month old daughter in 2006. After Shved's conviction in 2009 she was sentenced to 10 years in prison. She spent more than two years in prison before she was released on bond after the Washington Court of Appeals overturned her conviction in 2011 and ordered her retrial, because her jury was erroneously instructed about an uncharged prosecution theory of the crime. During her second trial Shved presented new medical evidence by multiple experts that no one caused her daughter's non-fatal injuries that were caused at least in part by an epileptic seizure. In acquitting Shved the judge ruled there was insufficient evidence she was guilty. A judge later restored the parental rights of Shved and her husband paving the way for them to again have custody of their two children. Prior to her retrial Shved turned down a plea bargain for a guilty plea to a misdemeanor that would have prevented her deportation, but her guilty plea would have barred restoration of her parental rights."
