Summary of Case:

"Jesus Silva-Santiago was wrongly convicted on June 16, 2006 of first-degree murder in the shooting death of Eugene Monteiro in Boston, Massachusetts on June 28, 2003. After his conviction by a jury Santiago was sentenced to life in prison. On May 15, 2009 the Massachusetts Supreme Judicial Court overturned Santiago's conviction and ordered a new trial on the basis two statements made by the prosecutor during his closing argument about alleged evidence that had not been introduced during the trial, and the judge's failure to correct them, constituted reversible error. During Santiago's retrial in 2010 he did not introduce any new evidence, however, without the prejudicial prosecutor statements he was acquitted by a jury on August 12, 2010. In 2012 Santiago filed a compensation claim with the State of Massachusetts under "Compensation for Certain Erroneous Felony Convictions" statute, G. L. c. 258D. The judge ruled against Santiago on the basis he failed to state a claim. Santiago appealed. On May 22, 2014 the Supreme Judicial Court affirmed the dismissal of Santiago's claim."
