In October 2011, after Simms had completed serving his sentence his conviction was vacated and the charges were dismissed. Simms was 62 when he died on June 4, 2012 from heart and lung problems. At the time of his death the Dallas County DA's Conviction Integrity Unit (CIU) was investigating Simms' claim of actual innocence. However, that investigation was effectively terminated with his death."
