Summary of Case:

"Ranjit Singh was wrongly convicted of violating a WorkSafe New Zealand order to stay away from an asbestos-filled work site on Symonds Street in Auckland, New Zealand in 2014. Singh's prosecution was based on him performing the "work" of removing a ramp at the worksite on March 22, 2014, after he went to the work site on March 17 to remove a truck and excavator that he had permission to remove. In June 2015 a District Court judge found Singh guilty of violating the Health and Safety in Employment Act by performing the "work" of removing the ramp in defiance of the stop work order. Singh was fined NZL$25,000. Singh appealed. In September 2015 New Zealand's High Court quashed Singh's conviction and his fine. Justice Patricia Courtney ruled that Singh's convictionn was a miscarriage of justice because permission to remove a truck and excavator extended to the removal of the ramp, and therefore the Court didn't need to address the issue of what constituted work at the site."
