Summary of Case: |
"Wrongly convicted in the Queenstown District Court in November 2008 of assaulting a patron in a Wanaka, New Zealand bar in October 2008. Sam Smoothy was a member of New Zealand's national ski team, and he was sentenced to pay a fine of NZL$400. On December 17, 2008 the High Court in Christchurch quashed Smoothy's conviction. In its decision the High Court stated, "The [trial] court should have been satisfied that the direct and indirect consequences of a conviction would be out of all proportion to the gravity of the offence,"" |
