"Ati George Sokomanu, Barak Sope, Maxime Carlot and Willie Jimmy were codefendants wrongly convicted on March 7, 1989 of seditious conspiracy, incitement to mutiny, and other charges in Vanuatu. On April 14, 1989 the Vanuatu Court of Appeal quashed the convictions of Sokomanu, Sope, Carlot and Jimmy based on insufficient prosecution evidence to prove their guilt beyond a reasonable doubt. The Court ruled: "The cumulative effect of all these matters is to leave us with a very real doubt - not just a lurking doubt - about the verdicts. If all the matters to which we have referred been put into the balance, we think it quite possible that the court would have reached different conclusions. We find the verdicts against each appellant on the charges of seditious conspiracy and incitement to mutiny unsafe and unsatisfactory. These verdicts are set aside. The remaining verdicts, relating to the taking of the oaths, stand or fall with the charge of seditious conspiracy and are also set aside. There is no question of ordering a new trial in these circumstances. Each of the appellants is discharged.""
