Summary of Case:	"Michael Spielvogel and Dr. James Scott Pendergraft were co-defendants wrongly convicted in 2001 in federal court of attempted-extortion, mail fraud and conspiracy related to a lawsuit they filed against Marion County, Florida. The lawsuit was related to opposition in Marion County to an abortion clinic the two men were planning to open in Ocala, the county seat of Marion County, that was opposed by many local people. Both men were sentenced to three years in prison. On July 16, 2002 the 11th U.S. Circuit Court of appeals vacated Pendergraft and Spielvogel's convictions on the basis their lawsuit against Marion County was insufficient evidence to prove they were conspired to attempt to extort money. Both men served seven months in prison before they were released."
