Summary of Case:

"Errol Reginald Standeven was wrongly convicted on September 26, 2014 of offensive behavior for taking photographs of women in Christchurch, New Zealand's Hagley Park. On August 7, 2014 a man called the police to report a man was taking photographs of women in the park. Standeven refused to talk with the police, but they confiscated his digital camera and found it contained 269 photos of clothed women taken in public. Charged with the misdemeanor of offensive behavior, the prosecution's case before two Justice of the Peace was based on the argument that the sheer number of photos Standeven took was offensive. Standeven testified in his defense that photography was his hobby. Although it is not illegal in New Zealand to photograph a person in a public place, and no person photographed had complained, the judges found Standeven guilty and fined him NZL$600. Standeven appealed. On April 15, 2015 Christchurch District Court Judge Jane Farish quashed Standeven's conviction and ordered that there not be a retrial on the basis there was no evidence he committed a crime. Judge Farish ruled that Standeven was at the park to take photographs, he did not hide or disguise himself, and that "The photographs show some fairly poor photography and in no way could they be described as salacious or offensive.""
