Summary of Case:

"Bryan Sullivan was wrongly convicted of rape on August 26, 2016. Sullivan was a U.S. Coast Guard Petty Officer who on the evening of May 20, 2015 went with friends and others to a bar in Cape May, New Jersey. Afterwards Sullivan and a female shipmate, A.R., went to her barracks and had sex. Within 48 hours A.R. reported that Sullivan raped her. He was charged with rape and making a false statement to a Coast Guard Investigative Services officer, who he told the sex was consensual. The prosecution's case was based on the testimony of A.R. Sullivan's statement the sex with A.R. was consensual was admitted into evidence. Sullivan was convicted after a general court martial of both charges, and was sentenced to seven years in a military prison. After his conviction Sullivan's lawyer discovered that because of a time zone difference A.R. had actually sent a text message in which she indicated she had no memory of what happened with Sullivan, 1 hour and 24 minutes after she and Sullivan checked into the base -- and not 24 minutes as had been testified to at trial. The correct timeline was consistent with Sullivan's defense. Sullivan's appeal incorporated the new evidence which was granted. During Sullivan's retrial evidence was presented by one of A.R.'s former boyfriends that she was known to lie, and A.R.'s truthfulness was attacked on cross-examination because she testified the first person she contacted after the alleged rape was her sister in Switzerland, which she had not claimed in her CGIS statement or her testimony during Sullivan's first trial. The court martial juror acquitted Sullivan on July 21, 2017."
