Summary of Case:	"Kwon Sun-taik was wrongly convicted on March 16, 2015 of pre-electioneering in June 2014 before a local election by unlawfully participating in forum activities, that he began doing in November 2012. Sun-taik was the mayor of Daejeon, South Korea -- 100 miles south of Seoul -- at the time he was charged. Sun-taik was able to continue as Daejeon's mayor pending the outcome of his appeal. On July 20, 2015 the Daejeon High Court affirmed Sun-taik's conviction, and sentenced him to eight months in prison suspended for two years of lawful behavior. Sun-taik appealed. On August 26, 2016 the South Korea Supreme Court vacated Sun-taik's conviction on the basis of insufficient evidence he commited his convicted crime, because the activities took place five months before election day and that Kwon did not ask for support for his election race. The prosecution had alleged that about 159 million won (US$138,092) of the membership fees collected by Sun-taik was illegal political funds, and the Supreme Court remanded for the lower court to determine how much, if any, of the money collected from forum members can be deemed illegal political funds."
