Summary of Case:

"Andrew Surritt Jr. was wrongly convicted on August 29, 1992 of breaking and entering and theft in Fayette County, Ohio. Surritt's prosecution was based on him breaking a lock to enter a house he had been building, and removing some building supplies he had paid for. The house's owner testified he didn't tell Surritt he had changed the lock and didn't want him on the property. After his conviction by a jury Surritt was sentenced to one year and six months in prison. On May 10, 1993 Surritt's convictions were reversed by the Ohio Court of Appeals on the basis the prosecution failed to introduce evidence proving every essential element of either of his convicted crimes. The Court ruled that Surritt was entitled to enter the property so he couldn't be guilty of breaking and entering, and he owned the items he took so he couldn't be guilty of theft. The appeals court ordered dismissal of the charges. Surritt had been released on May 3. Surritt filed a claim for compensation under Ohio's wrongful imprisonment statute. On June 19, 1995 the Ohio Court of Claims awarded Ward a total of $32,500."
