Summary of Case:

"Randy Lynn Tennyson was wrongly convicted in 2009 of soliciting a child on a computer. In 2006 Randy Tennyson was charged with using his computer to arrange to meet a 15-year-old girl in a public place in Demopolis, Alabama. He had actually been communicating with a Demopolis police detective. Tennyson agreed to a bench trial and he argued that he should be granted a judgment of acquittal because under Alabama law in 2006 a person was required to have actually solicited a minor for sex, and not an adult pretending to be a minor. The judge disagreed and after finding Tennyson guilty he was sentenced to 7 years in prison. On May 25, 2012 the Alabama Court of Criminal Appeals vacated Tennyson's conviction on the basis that he had not committed a crime because he had only communicated with an adult pretending to be a minor, while the law in 2006 required that a minor was solicited. The law was changed in 2009 to criminalize solicitation only if a person believed he or she was communicating with a minor -- while the person could actually be an adult."
