"James Tobin was wrongly convicted on December 15, 2005 of conspiracy to violate and of aiding and abetting a violation of 47 U.S.C. § 223(a)(1)(D) (Using a telephone with the intent to harass any person at the called number.) Tobin was sentenced on May 17, 2006 to 10 months in prison, 2 years supervised released, and a $10,000 fine. Tobin was allowed to remain free pending the outcome of his appeal. After the First Circuit Court of Appeals overturned James Tobin's conviction on March 21, 2007, the federal government attempted to reprosecute him. On January 7, 2009 the U.S. First Circuit Court of Appeals ruled that the alleged actions of James Tobin in 2002 did not fall under the statute for conduct that constitutes a crime, and thus "Tobin prevails, and this case ends.""
