Summary of Case: |
"Clinton Adam Treadway was wrongly convicted on January 12, 2006 of four counts of forgery and theft. Clinton Treadway was contacted by the police after his identification was used to cash four stolen checks at Polk County, Florida banks, although none of the tellers identified him as the person who cashed the checks. Treadway told the police that he had reported to the police that his identification had been stolen. However, the police told his lawyer that no stolen identification report was found, so he was charged and prosecuted on the basis that he had made up the story about his identification being stolen. Although he tellers didn't identify him, a handwriting expert testified it wasn't his signature on the checks, and there was no evidence linking him to the cashing of the checks, the jury convicted him. He was sentenced to 10 years in prison and 30 years of probation. After languishing in prison for more than six years a relative received a victim notification form in the mail sent to Clinton Tudway, concerning an identity theft ring investigation by The Office of the Statewide Prosecutor. Realizing that Treadways name had been misspelled when he reported the theft of his identification in 2005, his relatives hired a lawyer. The lawyers investigator discovered that not only had Treadways name been misspelled by the police as Tuadway when he made his report, but his identification had likely been stolen by a female co-worker and that one of the suspected members of the theft ring resembled the man in the bank surveillance photos. Based on the new evidence Treadway was the victim of identity theft and wasnt the man who cashed the stolen checks, his lawyer filed a Motion For Post-Conviction Relief. The motion was granted on July 3, 2012 and the judge ordered a new trial. The States Attorney filed a nolle prosequi on July 3. After serving 7 years and 25 days of his 10 year sentence, the 28-year-old Treadway was released on July 5, 2012. Florida State Senate Bill 24 filed in 2016, authorizes the payment of $350,000 to Clinton Treadway as compensation for his wrongful imprisonment. As of July 5, 2016 the bill was pending." |
