Summary of Case:

"Wesley Ronald Tuley was wrongly convicted of sexual assault after pleading guilty after a jury deadlocked on a verdict. Tuley claimed he only pled guilty in exchange for a 10 year sentence of community supervision because he had run out of money to pay for a lawyer for a second trial, he was facing a long prison sentence if convicted, and he had already spent 10 months in jail awaiting his first trial. Tuley was later imprisoned for violating the terms of his community supervision. Weley Tuley's accuser totally recanted her story and said she made it up because she didn't like Tuley and his relationship with his mother. Tuley filed a habeas corpus on the basis of the new evidence of his innocence, and his trial judge recommended the vacating of his conviction. In concurring with the trial court, the Texas Court of Appeals ruled that "The purpose of criminal proceedings is to separate the guilty from the innocent." By ordering the vacating of Tuley's conviction the Appeals Court established the precedent in Texas that a defendant's actual innocence is more important than their false plea of guilty."
