"Brad Turner was wrongly convicted in May 1997 of assaulting a 10-year-old student in his classroom in Montclair, New Jersey who had thrown a bag of grapes at a trash can and missed. Turner's conviction was based on the testimony of the student. Prior to his sentencing Turner filed a motion for a new trial, which was granted in November 1997 by his trial judge who ruled the prosecution failed to introduce evidence Turner "purposefully, knowingly or recklessly" injured the student."
