Summary of Case: |
"Darren W. Tustin was wrongly convicted of child pornography in October 2003 based on pictures found on a computer disk. Tustin was sentenced to one year in prison and sentenced to register as a sex offender for ten years. He served six months in prison. Tustin appealed his conviction, and in April 2007 it was quashed by a unanimous three-judge panel of the Criminal Appeal Court on the basis of two grounds. First, the prosecution had not provided Tustin's lawyer with copies of the disk the pictures were found on so his computer expert could examine them and make an evaluation. Second, there was no evidence presented by the prosecution that Tustin had any knowledge of what was on the disk. The Court did not order a retrial, because the prosecution didn't present evidence at Tustin's trial that could establish his guilt." |
