Summary of Case:

"Fernando Valencia was wrongly convicted in April 2016 of defamation against Peru's former President Alan Garcia Perez. Valencia's alleged defamatory statement on television was: “Humala lashes out against the Aprista government: Thieves to jail, not in power." That was accompanied by photos of Peru’s then-President Ollanta Humala and former President Garcia Perez. After his conviction Valencia was sentenced to 20 months in prison and payment of S/ 100,000 in damages to Perez. Valencia appealed. On August 9, 2016 the Fourth Criminal Court of Lima overturned Valencia's conviction. After the ruling, Valencia's lawyer, Carlos Rivera, told reporters: “This is an important legal victory, even more so for those who exercise journalism and freedom of expression. From the beginning, we said that the complaint was arbitrary because it was criminalizing a journalistic act.”"
