Summary of Case: |
"Seven codefendants were wrongly convicted in 2002 of criminal trespass, demanding money with menaces, assault, and threats in Vanuatu in 2001. The codefendants were prosecuted based on the allegation that they boarded a boat to claim unpaid wages. After their conviction following a bench trial, all seven were sentenced to four years in prison. They all appealed. On January 14, 2003 the Court of Appeal of Vanuatu quashed the convictions of the seven codefendants based on the prosecution's failure to introduce sufficient evidence to prove their gult beyond a reasonable doubt. They were released after five months in custody." |
