Summary of Case:

"Revat Rene Vara was wrongly convicted on March 17, 2007 of driving under the influence of alcohol in Houston, Texas on March 11, 2006. Because of prior DUI convictions, after his conviction by a jury the sentece of Revat Vara was enhanced as a repeat offender to 25 years in prison. After his conviction was affirmed on dirct appeal, Vera filed a petition for a writ of habeas corpus that among its claims asserted is trial lawyer didn't object to the introduction of testimony about his prior misdemeanor DUI convictions, and failed to investigate the background of the arresting officers, particularly William Lindsey Jr., who at the time of Vara's arrest was under invetigation by the Houston Police Depart for manipulating drunk driving cases to generate overtime income, and less than six months after Vara's arrest Lindsey resigned. On May 13, 2013 the habeas court judge recommended the granting of Vara's petition, and on May 28, 2013 his case was filed in the Texas Court of Criminal Appeal for its review of the judge's ruling. On January 13, 2016 the Court of Criminal Appeal granted Vara's post-conviction habeas petition and ordered his retrial on the basis his trial lawyer provided ineffective assistance of counsel. The Harris County District Attorney's Office declined to retry Vara, and their motion to dismiss the charges against him was granted on September 12, 2017. Vara was subsequently released from the custody of the Texas DOC."
