Summary of Case:

"Mukesh Vasava and Amarsing Vasava were codefendants wrongly convicted in March 2016 of raping a minor in Rajpipla, India in May 2015. During the Vasava's trial the prosecution did not present any eyewitness or medical evidence linking the two young men to the rape of the girl. The alleged victim did not identify them during their trial -- although she did identify them during the identify parade. After they were found guilty, the trial court sentenced the Vasava's to seven years in prison. They appealed. In August 2016 the Gujarat High Court overturned the Vasava's conviction and ordered their acquittal on the basis the prosecution introduced insufficient evidence of their guilt, and that the lower court's verdict was a "moral conviction." The appeals court ruled that the pre-trial identify parade identification, although a "corroborative piece of evidence, cannot take place of substantive evidence.""
