Summary of Case:

"Hector Vazquez was wrongly convicted on November 8, 2004 of being involved in a cocaine distribution ring in Texas based on the eyewitness testimony of three DEA agents. No physical evidence or other witness linked Vazquez to the "ring." After Vazquez's conviction by a jury, but prior to his sentencing scheduled for March 4, 2005, two of the "rings" members who were fugitives were captured and based on the new evidence they provided that Vazquez was not involved, Vazquez filed a post-verdict motion for a new trial During the subsequent hearing on that motion, the two "ring" members testified that Vazquez had nothing to do with the distribution ring. During that same hearing the three DEA agents reiterated theri trial testimony. U.S. District Judge John McBryde set aside Vazquez' drug conviction on April 1, 2005 and ordered a new trial. Based on the new evidence, a federal grand jury did not reindict Vazquez. He was not released, however, because he was indicted for being a felon in possession of a firearm, and after convicted of that charge by a jury on June 7, 2005 Vazquez was sentenced to 70 months in federal prison."
