Summary of Case:

"Earl E. Vick was wrongly convicted in 1953 of multiple federal charges related to the operation of an unregistered still and possession of alcohol without revenue stamps in Georgia. The trial judge denied Vick's motion for a judgment of acquittal at the close of the prosecution's case, and the jury convicted him. Vick appealed. On October 29, 1954 the U.S. Fifth Circuit Court of Appeal reversed Vick's convictions and ordered his acquittal based on the prosecution's introduction of insufficient evidence to prove his guilt beyond a reasonable doubt. The Court's ruling stated: "...his conviction cannot rest upon mere conjecture and suspicion. The evidence does not prove him guilty beyond a reasonable doubt and is not sufficient to warrant the jury in so concluding. The judgment is, therefore, reversed with directions to grant the appellant's motion for judgment of acquittal." Vick v. United States, 216 F. 2d 228 (5th Cir. 1954)"
