Based on the new evidence White post-conviction petition for a new trial was granted by the trial judge on March 17, 2014. The State appealed, but on February 6, 2015 the New York Supreme Court's Appellate Div. affirmed the grant of a new trial based on the fact the new evidence could likely result in a verdict other than guilty."
